Terms and Conditions

1) Applicability
1.1 All our offers and deliveries are subject to our General Terms and Conditions of Sale.
1.2 These Terms and Conditions are exclusively subject to Dutch law.
1.3 By placing an order in our online store, you accept our General Terms and Conditions.
1.4 The vast majority of Ogreen products are protected under copyright laws. It is not permitted to use all or part of the electronic images found on this website without the prior written consent of Noviflora Holland BV.

2) Agreement
2.1 The contents of these General Terms and Conditions will be made available to the consumer prior to the signing of the Distance Selling Agreement. If this is not reasonably possible, it will be communicated that the General Terms and Conditions are available for inspection at the business and that they will be sent to the consumer at the latter’s request free of charge as soon as possible.
2.2 If the Distance Selling Agreement is entered into electronically, the contents of these General Terms and Conditions will be made available to the consumer electronically such that he/she can easily save the document to a durable medium. If this is not reasonably possible, the electronic medium through which the General Terms and Conditions can be accessed will be communicated prior to the signing of the Distance Selling Agreement, along with the message that they will be sent to the consumer electronically or by other means at the consumer’s request free of charge.

3) Product prices/shipping costs
3.1 The prices listed are unit prices stated in euro.
3.2 The prices listed are inclusive of VAT.
3.3 The price does not include shipping costs.
3.4 VAT rates vary by product group: the rate for plants is 6%, while that for other products is 21% (Statutory VAT is subject to change). 
3.5 Ogreen reserves the right to modify prices on the website at any time. Any orders placed are delivered at the price stated in the confirmation e-mail.
3.6 Orders in excess of €20 to be delivered to a single address will be delivered free of charge.

4) Shipping countries
4.1 We deliver to the following countries: the Netherlands
4.2 Delivery in the Netherlands is available from Tuesday to Saturday.
4.3 Delivery to the Wadden Islands may take up to two days. Saturday delivery is not available for the Wadden Islands.
4.4 In the Netherlands, we can deliver on the next date of delivery if the order was processed before 3:00 p.m.

5) Delivery
5.1 Standard orders are delivered between 9:00 a.m. and 6:00 p.m. on the desired date of delivery.
5.2 A total of 95% of fresh flowers are delivered on the requested date of delivery. However, in some cases the plants may be delivered one day later due to unforeseen circumstances affecting our transport company, e.g. heavy traffic. This will have no effect on the plants, as they are shipped in specially packed containers to protect them in transit. 5.3 Delivery is not available on Dutch national public holidays or the day after such holidays.
5.4 Any other orders are delivered within three working days.
5.5 The customer is responsible at all times for providing the correct address of the recipient. If the address details are inaccurate, if the name of the recipient is missing or if the name on the door or P.O. Box is incorrect or if the recipient refuses the delivery, as a result of which the consignment cannot be delivered, the purchase price and shipping costs will be charged to the customer. Any costs arising from a loss of quality caused by delays in delivery because the order was delivered to neighbours or a custodian will likewise be borne by the customer.
5.6 We make every effort to ensure that our products are carefully packaged. If you are nevertheless dissatisfied with the quality of your order or if the products you received are damaged, please contact us as soon as possible.
5.7 Alternate, fixed delivery dates may apply during special promotional campaigns and on national public holidays. This will always be clearly communicated in the confirmation.

6) Payment
6.1 Orders must be paid by credit card, PayPal or the Dutch iDEAL online payment tool in our online store prior to delivery.
6.2 We also accept invoice orders from businesses. Please contact Ogreen at mail@Ogreen.eu to place an order or if you have any questions.
6.3 You will receive an e-mail confirmation as soon as you have paid for your order in our online store. This confirmation, which also serves as an invoice, lists the amount you paid in Dutch VAT.

7) Complaints
7.1 We will make every effort to deliver the highest quality products to you in time. If you nevertheless find that your order does not meet your expectations, please contact us within three working days, preferably by e-mail at mail@ogreen.eu
7.2 Since plants are fresh products, the structure of the plant may vary from the image contained on the website. However, the overall look and value of the plant will be at least equivalent to the image shown.

8) Special offers/discounts
8.1 Any special offers and/or discounts are valid only for the individual offer. Discounts cannot be combined.

9) Packaging
9.1 The cardboard container is not 100% waterproof.

10) Minors
10.1 Ogreen only enters into contracts with individuals at least 18 years of age or minors who have received express permission from a person over the age of 18.

11) Intellectual property
11.1 All photographs, illustrations, copy, visual materials, names, trade names and logos used by Ogreen are the property of or licensed to Noviflora Holland BV and are protected by copyright laws, trademark laws and/or any other intellectual property rights. It is not permitted to copy, distribute, transmit or disclose any of the above to third parties (at a charge) without the express prior written consent of Noviflora Holland BV.

12) Cancellations
12.1 Customers can cancel orders in writing without stating reasons up to 48 hours prior to the desired delivery date.
